Kevin Kimwatu Withdraws Case Challenging Rosemary Kimwatu’s Burial

Kevin Migwe Kimwatu, the husband of the late KCB executive Rosemary Chemutai Koech-Kimwatu, has withdrawn the court case he filed challenging her burial arrangements.

Kimwatu, through his lawyer Ramadhan Abubakar, informed the Milimani court on Monday that he no longer wished to pursue the matter, noting that Rosemary had already been laid to rest.

His lawyer told Milimani Principal Magistrate Agnes Mwangi that Kimwatu had instructed him to withdraw the suit in its entirety. The magistrate allowed the withdrawal without orders as to costs.

Kimwatu had initially moved to court seeking to be involved in his wife's funeral arrangements and had wanted her buried at their ancestral home in Matasia, Ngong, Kajiado County.

The dispute arose after Rosemary's family proceeded with her burial at the family home in Chepseon, Kericho County, despite interim court orders that barred the burial without Kimwatu's involvement.

With the burial already completed, Kimwatu has now indicated that he will not seek the exhumation of Rosemary's remains or pursue contempt proceedings against her relatives and other parties involved in the dispute.

His lawyer told the court that Kimwatu had chosen to leave the matter to God, effectively bringing the case over Rosemary's final resting place to an end.

Kimwatu also asked to be allowed to visit Rosemary's gravesite together with their four children and other family members.

Rosemary's parents, Paul and Beatrice Koech, did not object to the request. Their lawyer told the court that Kimwatu remains welcome to visit the gravesite at any time, describing him as their son and his children as their grandchildren.

The withdrawal marks the end of the court dispute over Rosemary's burial arrangements and opens the way for both families to move forward as they grieve and support the children she left behind.
